What Is RERA AGENT REGISTRATION?

All brokers will have to compulsorily registered with the concerned state-level regulatory authorities. Real estate agents will be given a registration number by the authority which will be valid for 5 years and will be renewed thereafter .

If any real estate fails to register , they will be liable for penalty.

Why is RERA AGENT REGISTRATION required?

Real estate agents are the heart of real estate industry . They are the mediators facilitating transactions between builder and buyer . With RERA, that will soon come into force, all brokers will have to be mandatorily registered with the concerned state-level regulatory authorities. Real estate agents will be given a registration number by the authority which will be valid for 5 years and will be quoted in every transaction facilitated by him.


ļ»æReal estate agents will also be penalized if they will falsely represent any information regarding project to buyers. Penalty will extend upto Rs 10,000 per day and maximum 5% of total project cost. Real estate agent is also required to keep books of accounts of the projects they are indulged in and are answerable for them.

What is the timeline for getting RERA AGENT REGISTRATION certificate?

Normally it takes 25-30 working days to get MAHARERA agent registration certificate.

What is the validity of RERA AGENT REGISTRATION certificate?

Certificate once obtained shall be valid for 5 years which can be renewed after expiry. The fees for MAHARERA Agent renewal shall be same as registration.

What is the Government Fees for RERA AGENT REGISTRATION?

The Government fees for MAHARERA Agent Registration is INR 10000/- + 590/- GST i.e INR 10,590/- only

What Is RERA PROJECT REGISTRATION?

RERA makes it mandatory for all commercial and residential real estate projects where the land is over 500 square meters or eight apartments will have to register with regulator before launching a project. Every promoter shall make an application to the authority for registration of real estate project. Projects that are ongoing on the date of commencement of this act and for which completion certificate have not been issued have to get registered with RERA. If real estate project fails to register a property, it will attract penalty.

Why is RERA PROJECT REGISTRATION required?

The Real Estate (Regulation & Development) Act, 2016 aims to establish the Real Estate Regulatory Authority that would regulate and promote the real estate sector. The main aim of the Act is to protect the interest or buyers and promote timely delivery of properties or projects. All the projects either on land more than 500 sq. m or having at least eight apartments, including the one without completion or occupancy certificate must be registered. Developers have to post details like project plan, layout plan, approvals, land title status, details of promoters, contractors, architects, date of completion with the State RERA ā€“ Customers can access this information from the RERA websites.

Developers have to put aside 70% of project funds in an escrow account linked to the project. Builder will be penalized if there is delay in project deliveries. The carpet area hasbeen clearly defined in the law.

What is the timeline to get RERA PROJECT REGISTRATION?

Normally it takes 45-60 working days to get MAHARERA Project registration certificate.

Certificate once obtained shall be valid till the date of expiry. The project needs to be extended before the expiry period.

What is the Government fees for RERA PROJECT REGISTRATION?

The Government fees for Project Registration anywhere in state of Maharashtra is INR 10/- per sq. metre or minimum of INR 10885/- only

What is PROJECT EXTENSION?

The registration of project granted under Section 5 of the RERA Act, 2016 may be extended by the authority. Section 6 of the RERA Act, 2016 explains the provision of Extension of registration of a project. This section further clarifies that registration may be extended by the authority on an application made by the promoter due to force majeure, in such form and on payment of such fee as may be specified by specific state regulations made by the RERA Authority. The term force majeure shall mean a case of war, flood, drought, fire, cyclone, earthquake or any other calamity caused by nature affecting the regular development of the real estate project. However, the Authority may in reasonable circumstances, without default on the part of the promoter, based on the facts of each case and for reasons to be recorded in writing, extend the registration granted to a project for such time as it considers necessary, which shall, in aggregate, not exceed a period of 1 year

What is RERA Quarterly Update?

The RERA Act, 2016 became effective from 1st May, 2016 with 69 sections notified out of 92 sections. RERA is introduced to protect buyerā€™s interest, enhance professionalism and ensure transparency in the real estate sector. To infuse transparency into the system and have a Control Mechanism over the ongoing projects of the registered developers, the RERA Authority has come up with the Quarterly Compliance system. As per Section 4(2)(I)(D) of the RERA Act, 2016 a separate account has to be maintained in which 70% of the amount collected from the homebuyers shall be deposited which shall strictly be used by the developer in its project only. After submitting documents of quarterly compliance with the banks stating the % completion of work, this separate account amount can be withdrawn. Hence, this act as a tool of governance to verify the actions.

What is RERA AGENT RENEWAL?

The RERA Certificate of a real estate agent is valid from 5-10 years, depending upon the state of RERA registration. After Expiry, the same needs to be renewed for another 5 years.

The renewal window opens after the expiry of the existing registration certificate. The RERA Agent Renewal can be done in the same name as RERA agent registration obtained earlier.
